Terms of Service

1. Acceptance of Terms

By creating an account or using the BBH Cabinets mobile application (the "App"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the App. BBH Cabinets ("BBH," "we," "us") may update these Terms from time to time; continued use after changes means you accept the updated Terms.

2. Who Can Use the App

The App is intended for contractors, builders, realtors, interior designers, homeowners, and BBH staff who are at least 18 years old (or the age of majority in your jurisdiction) and capable of forming a binding contract.

3. Accounts

  • You must provide accurate account information and keep it up to date

  • You're responsible for activity under your account and for keeping your login credentials secure

  • Notify us promptly at sales@bbhcabinets.com if you suspect unauthorized use of your account

  • We may suspend or terminate accounts that violate these Terms or that we reasonably believe pose a security or fraud risk

4. Projects, Content, and Sharing

When you create a project, upload photos/videos, or send messages in the App, you retain ownership of that content, but you grant BBH a license to use it to provide the App's services to you — for example, generating quotes, producing designs, and fulfilling orders.

If you use the project-sharing feature to share a project with a client or contractor, you're responsible for what you choose to share, including whether wholesale pricing is visible.

5. AI Room Measurements

The App's AI measurement feature provides estimated measurements based on photos or video you provide. These are estimates only, may be inaccurate, and must be confirmed or corrected by you or a BBH designer before being used for ordering or production. BBH is not responsible for losses arising from unconfirmed or uncorrected AI-estimated measurements.

6. Quotes and Orders

  • Quotes generated in the App are estimates and are not binding until you approve them and BBH confirms the order

  • Prices, availability, and lead times shown in the catalog are subject to change and confirmation at time of order

  • Once an order is confirmed and production begins, cancellation or changes may not be possible without a fee — details will be provided at time of order

7. Payments

  • Accepted payment methods include credit card, debit card, ACH, and electronic check

  • Credit and debit card payments carry a 3.5% processing fee, shown to you before you confirm payment

  • Payments are processed by a third-party payment processor; by making a payment you also agree to that processor's terms

  • You represent that you're authorized to use the payment method you provide

8. Delivery

Delivery timelines shown in the App are estimates. BBH will notify you of status updates and any changes to expected delivery dates.

9. Warranty Claims

Claims for damaged, missing, or incorrect cabinets or parts may be submitted through the App as described in our warranty terms. Submitting a claim does not guarantee approval; BBH reviews each claim and may request additional information, photos, or video. Approved remedies (repair or replacement) are at BBH's discretion consistent with our warranty policy.

10. Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose or to violate any applicable law or regulation

  • Upload content that is false, misleading, infringing, or that you don't have the right to share

  • Attempt to interfere with, disrupt, or gain unauthorized access to the App or its systems

  • Use another person's account without permission

  • Misuse the messaging feature to harass, spam, or send unlawful content

11. Intellectual Property

The App, including its design, logos, cabinet catalog content, and software, is owned by BBH Cabinets or its licensors and is protected by intellectual property laws. These Terms don't grant you any rights to BBH's trademarks, logos, or catalog content beyond what's needed to use the App as intended.

12. Disclaimers

The App is provided "as is" and "as available." To the fullest extent permitted by law, BBH disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't guarantee the App will be uninterrupted, error-free, or that AI-generated measurements or designs will be fully accurate.

13. Limitation of Liability

To the fullest extent permitted by law, BBH will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the App. BBH's total liability for any claim relating to the App will not exceed the amount you paid to BBH for the order giving rise to the claim, or $100 if no order is involved. 14. Termination

You may stop using the App and request account deletion at any time. We may suspend or terminate your access if you violate these Terms or for security, legal, or business reasons, with notice where reasonably possible.

15. Governing Law

These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-law principles, unless otherwise required by applicable law. [Confirm with your attorney — this should match where BBH is legally formed/operates.]
